CG 00 09 Owners and Contractors Protective Liability

Provides separate liability coverage for a project owner or general contractor hiring subcontractors. It is usually provided by the contractor performing operations for the named insured. Coverage is limited to the designated site or location of work. This form can be modified with endorsement CG 28 07 to apply to any principal's liability for the acts of agents.

CG 00 33 Liquor Liability (Occurrence Version)

Affords occurrence liability protection for the liquor legal liability of a risk engaged in the business of manufacturing, distributing, selling, serving or furnishing alcoholic beverages.

CG 00 34 Liquor Liability (Claims-Made Version)

Affords claims-made liability protection for the liquor legal liability of a risk engaged in the business of manufacturing, distributing, selling, serving or furnishing alcoholic beverages.

CG 00 35 Railroad Protective Liability

Protects a railroad company from liability arising out of operations performed on or near railway property. It is usually provided by the contractor performing the operations.

CG 00 37 Products/Completed Operations Liability (Occurrence Version)

Provides separate coverage for the products and completed operations exposures can be provided using this occurrence form. It provides coverage similar to the CGL occurrence coverage part.

CG 00 38 Products/Completed Operations Liability (Claims-Made Version)

Provides separate coverage for the products and completed operations exposures can be provided using this claims-made form. It provides coverage similar to the CGL claims-made coverage part.

CG 00 39 Pollution Liability Coverage Form Designated Sites

Provides pollution liability coverage on a claims-made basis, including the cost of site clean up.

CG 00 40 Pollution Liability Limited Coverage Form Designated Sites

Provides pollution liability coverage on a claims-made basis. The limited form does not cover the cost of site cleanup.

CG 00 65 Electronic Data Liability Coverage Form

Provides coverage on a claims-made basis for loss of electronic data caused by the insured.

CG 00 66 Product Withdrawal Coverage Form

Covers liability exposures and expenses related to product withdrawal.

CG 00 68 Recording and Distribution of Material or Information in Violation of Law Exclusion

Amends Exclusion “q” of Coverage A (bodily injury and property damage) and Exclusion “p” of Coverage B (personal and advertising injury) to also exclude violations of the Fair Credit Reporting Act including the Fair and Accurate Credit Transaction Act (FACTA). (Note: ISO withdrew this endorsement with the 2013 edition, as these changes were incorporated into the basic coverage form.

CG 01 01 Texas Changes - Airport Liability

Modifies the policy to provide coverage needed for airports.

CG 01 03 Texas Changes - Conditions Requiring Notice

Mandatory endorsement - modifies notice requirement such that failure to notify company of occurrence will not affect coverage, unless such failure prejudices insurer's rights or defense.

CG 01 13 Texas Changes - Experience Rating Modification

Used with experience - rated risks to show experience rating date.

CG 01 36 Texas Changes - Your Right to Claim and Occurrence Information

Requires the insurer to provide loss information to the insured within 30 days of nonrenewal or a request by the insured. Mandatory endorsement for the CGL claims-made version.

CG 01 37 Texas Changes - Your Right to Claim and Injury Information

Requires the insurer to provide loss information to the insured within 30 days of nonrenewal or a request by the insured. Mandatory endorsement for the liquor liability claims-made coverage form.

CG 01 38 Texas Changes - Your Right to Claim and Occurrence Information

Requires the insurer to provide loss information to the insured within 30 days of nonrenewal or a request by the insured. Mandatory endorsement for the products and completed operations claims-made coverage form.

CG 01 56 Texas Changes - Pesticide or Herbicide Applicator Coverage

Provides a minimum of $5,000 property damage coverage for unique exposures of these risks. Modifies care, custody, control exclusion so that property damage is covered at premises where operations are performed, subject to limit on endorsement. Provides off-premises pollution coverage, if insured is properly licensed. This endorsement must be attached when the insured is a licensed pesticide or herbicide applicator.

CG 01 69 Texas - Excess Loss Premium Factors

Obligates the insurer to provide notice to a person or organization named in the endorsement in the event of cancellation or material change that reduces or restricts the insurance.

CG 02 05 Amendment of Cancellation Provisions or Coverage Change

Obligates the insurer to provide notice to a person or organization named in the endorsement in the event of cancellation or material change that reduces or restricts the insurance.

CG 02 24 Earlier Notice of Cancellation By Us

Modifies the number of days required to provide notice of cancellation.

CG 03 00 Deductible Liability Insurance (For Use With CGL and Products Policies)

Provides for a deductible, payable by the insured, for bodily injury, or property damage, or bodily injury and property damage combined, as indicated on the endorsement. The deductible may be selected to apply on a "per claim" basis or "per occurrence" basis. A "per claim" deductible would be applied to each claim arising out of one occurrence. The insured agrees to reimburse the company for the amount of the deductible, and all other rights and duties under the policy (such as defense) are unchanged.

CG 03 05 Deductible Liability Insurance (For Use With Liquor Policies)

Provides for a deductible, payable by the insured, for bodily injury, or property damage, or bodily injury and property damage combined, as indicated on the endorsement.

CG 04 22 Pollution Liability Coverage Extension

Removes all of paragraph (1.) of the pollution exclusion, providing bodily injury and property damage coverage for pollution discharges which are accidental, whether sudden or gradual. Cleanup costs are still excluded.

CG 04 24 Coverage for Injury to Leased Workers

Amends the definition of "employee" to remove leased workers from the definition, so that the employee injury exclusion does not apply to cover injuries to leased workers.

CG 04 28 Pollution Exclusion - Named Peril Limited Exception for a Short-term Pollution Event

Creates an exception to the pollution exclusion; covers escape of pollutants at an identified place and time that begins and ends within 48 hours when caused by certain named perils.

CG 04 29 Pollution Exclusion - Limited Exception for a Short-term Pollution Event

Same as CG 04 28, except not limited to cause by named perils.

CG 04 30 Pollution Exclusion - Limited Exception for Designated Pollutant(s)

Creates an exception to the pollution exclusion to cover the escape of a pollutant specifically listed in the endorsement schedule.

CG 04 31 Year 2000 Computer-Related and Other Electronic Problems - Limited Coverage Options

Excludes claims arising out of the Year 2000 computer problems, with exceptions for operations or locations specified in the endorsement. See CG 21 60 for an absolute Year 2000 exclusion.

CG 04 35 Employee Benefit Liability Coverage

Covers the insured's legal liability for damages caused by an act, error or omission in the administration of employee benefit programs, on a claims-made basis and subject to limits shown in the endorsement. An extended reporting period is needed when claims-made coverage is canceled or not renewed and is not replaced by similar coverage with a retroactive date that includes the prior period of coverage. Endorsement CG 27 15 is used to provide an extended reporting period.

CG 04 37 Electronic Data Liability

Used as an alternative to mandatory endorsement CG 21 06 to add coverage for property damage to electronic data when such damage arises out of physical injury to tangible property, subject to a separate limit. Like endorsement CG 21 06, this endorsement excludes damages arising out of access to or disclosure of confidential or personal information.

CG 04 49 Texas Changes - Limited Product Withdrawal Expense Endorsement

Provides reimbursement for expenses incurred because of a covered product withdrawal, subject to an aggregate limit and deductible shown in the endorsement. Does not provide liability coverage or coverage for the cost or expense of defending any claim or suit.

CG 20 01 Primary and Noncontributory - Other Insurance Condition

Adds wording to the Other Insurance condition to state that the insurance is primary to and will not seek contribution from any other insurance available to an additional insured, when the named insured has agreed in writing that the insurance would be primary and noncontributory.

CG 20 03 Additional Insured - Concessionaires Trading Under Your Name

Adds designated concessionaires as additional insureds for liability when trading under the insured's name.

CG 20 04 Additional Insured - Condominium Unit-Owners

Adds unit-owners as additional insureds for liability arising out of common areas. Must be attached when condominium associations are insured

CG 20 05 Additional Insured - Controlling Interest

Cover the liability of a parent corporation which arises from the subsidiary's operations. Adds the designated person or organization as an additional insured, but only for liability arising out of financial control of the named insured or a premises owned by the additional insured and leased or occupied by the named insured. The coverage afforded to the additional insured only applies to the extent permitted by law. If additional insured status is required by contract or agreement, coverage and limits of liability apply only to the extent required in the contract or agreement.

CG 20 07 Additional Insured - Engineers, Architects or Surveyors

Adds an architect, engineer or surveyor "engaged by you" as an additional insured, excluding their professional liability. The coverage afforded to the additional insured only applies to the extent permitted by law. If additional insured status is required by contract or agreement, coverage and limits of liability apply only to the extent required in the contract or agreement. This endorsement was withdrawn from use in 2012 but reinstated in 2013. See CG 33 91 for the special Texas endorsement introduced in 2012 but withdrawn in 2013. Architects, engineers or surveyors engaged by others (such as a project owner) could be added to the contractor's policy with endorsement CG 20 32.

CG 20 08 Additional Insured - Users of Golfmobiles

Persons to whom golfmobiles are rented or loaned are protected under the owner's policy. Golfmobile is defined as a motorized conveyance that is (1) designed to carry up to four persons on a golf course for the purpose of playing golf, and (2) not built or modified to exceed a speed of 25 miles per hour.

Coverage for additional insured limited to liability arising out of ongoing operations of named insured. It does not provide coverage for liability arising out of completed operations, and it is not intended to cover the additional insured's own supervision of work. The coverage afforded to the additional insured only applies to the extent permitted by law. If additional insured status is required by contract or agreement, coverage and limits of liability apply only to the extent required in the contract or agreement. This endorsement was withdrawn from use in 2012 but reinstated in 2013. See CG 33 95 for the special Texas endorsement introduced in 2012 but withdrawn in 2013. See CG 20 33 to provide automatic additional insured status.

CG 20 11 Additional Insured - Managers or Lessors of Premises

Adds a premises owner or manager as additional insured under tenant's policy. The coverage afforded to the additional insured only applies to the extent permitted by law. If additional insured status is required by contract or agreement, coverage and limits of liability apply only to the extent required in the contract or agreement. Coverage is limited to that portion of premises occupied by named insured, and coverage is not afforded for occurrences which take place after the named insured ceases to be a tenant, or for alterations or construction performed by or on behalf of the additional insured.

CG 20 12 Additional Insured - State or Governmental Agency or Subdivision or Political Subdivision - Permits or Authorizations

Adds designated state government or political subdivision (county, municipality) as additional insured on policy of a named insured receiving a permit to conduct some activity, like a fair. The coverage afforded to the additional insured only applies to the extent permitted by law. If additional insured status is required by contract or agreement, coverage and limits of liability apply only to the extent required in the contract or agreement. Coverage for additional insured applies only to current operations of insured (not past) and not to any work performed for the additional insured.

CG 20 13 Additional Insured - State or Governmental Agency or Political Subdivision or Political Subdivision - Permits or Authorizations Relating To Premises

Same as above, except applies only to permits relating to premises use, such as the erection of a sign.

CG 20 14 Additional Insured - Users of Teams, Draft or Saddle Animals

Adds users of such animals as additional insureds.

CG 20 15 Additional Insured - Vendors

Adds a designated person or organization (a vendor) as an additional insured to a manufacturer's or distributor's policy to protect them for liability arising out of sale or distribution of the named insured's products. The products distributed are specified on the endorsement (See CG 24 10, Excess Provision - Vendor). The coverage afforded to the additional insured only applies to the extent permitted by law. If additional insured status is required by contract or agreement, coverage and limits of liability apply only to the extent required in the contract or agreement. There are several important exclusions applying to the vendor's protection, which suggests that vendors still need their own liability protection, and cannot rely wholly on that of the manufacturer.

CG 20 17 Additional Insured - Townhouse Associations

Adds individual townhouse owners as additional insureds for liability as a member of the townhouse association. Must be attached to policies insuring townhouse associations. Does not cover liability arising out of the townhouse owner's individual property.

CG 20 18 Additional Insured - Mortgagee, Assignee, or Receiver

Adds the designated interest as an additional insured to a policy covering the named insured's property. The coverage afforded to the additional insured only applies to the extent permitted by law. If additional insured status is required by contract or agreement, coverage and limits of liability apply only to the extent required in the contract or agreement. Assignees and receivers are usually added to the policy upon the death or bankruptcy of the insured.

CG 20 20 Additional Insured - Charitable Institutions

Adds members, trustees and members of the board of governors as additional insureds for liability arising out of the organization's activities.

CG 20 22 Additional Insured - Church Members and Officers

Must be attached to policies insuring churches. Adds members, trustees and clergymen as additional insureds for liability arising out of church activities. Deletes the medical payments exclusion for injury to insureds.

CG 20 24 Additional Insured - Owners or Other Interests From Whom Land Has Been Leased

Adds the interest of the owner of land to the tenant's policy. The land so leased must be designated on the endorsement. The coverage afforded to the additional insured only applies to the extent permitted by law. If additional insured status is required by contract or agreement, coverage and limits of liability apply only to the extent required in the contract or agreement. Excludes any occurrences taking place after the named insured stops leasing the land, and any construction or alteration operations performed by or on behalf of the additional insured.

CG 20 25 Additional Insured - Elective or Appointive Executive Officers of Public Corporations

Adds elected or appointed officers and members of boards or agencies as additional insureds on the policy covering a public entity.

CG 20 26 Additional Insured - Designated Person or Organization

Adds a designated person or organization as an additional insured for liability arising out of the named insured's premises or operations. This endorsement can be used to add any interest to the policy, subject to company approval. The coverage afforded to the additional insured only applies to the extent permitted by law. If additional insured status is required by contract or agreement, coverage and limits of liability apply only to the extent required in the contract or agreement.

CG 20 27 Additional Insured - Co-Owners of Premises

Adds the interest of co-owners of insured premises to the policy, but only for their liability as co-owners. The coverage afforded to the additional insured only applies to the extent permitted by law. If additional insured status is required by contract or agreement, coverage and limits of liability apply only to the extent required in the contract or agreement.

CG 20 28 Additional Insured - Lessor of Leased Equipment

Adds the interest of the owner of equipment to a policy covering the named insured who leased the equipment. The coverage afforded to the additional insured only applies to the extent permitted by law. If additional insured status is required by contract or agreement, coverage and limits of liability apply only to the extent required in the contract or agreement. Protection is afforded only for liability arising out of the named insured's maintenance, operation or use of the equipment. Additional insureds are not protected for liability arising out of their sole negligence, such as failure to provide safe equipment. This endorsement was withdrawn from use in 2012 but reinstated in 2013. See CG 33 96 for the special Texas endorsement introduced in 2012 but withdrawn in 2013.

CG 20 29 Additional Insured - Grantor of Franchise

Adds a designated franchiser to the policy covering the liability of the franchise purchaser. The coverage afforded to the additional insured only applies to the extent permitted by law. If additional insured status is required by contract or agreement, coverage and limits of liability apply only to the extent required in the contract or agreement.

CG 20 30 Oil or Gas Operations - Non Operating Working Interests

Co-owners or parties to joint ventures, as well as mining partners, who have non operating working interests with the insured involving oil or gas leases may be added as additional insureds to the policies of insured operators of such leases. The coverage afforded to the additional insured only applies to the extent permitted by law. If additional insured status is required by contract or agreement, coverage and limits of liability apply only to the extent required in the contract or agreement.

CG 20 31 Additional Insured - Engineers, Architects or Surveyors

(Applicable only to the Owners and Contractors Protective Liability Coverage Part) Adds these professionals as additional insureds (excluding professional liability) when they are engaged by the named insured. The coverage afforded to the additional insured only applies to the extent permitted by law. If additional insured status is required by contract or agreement, coverage and limits of liability apply only to the extent required in the contract or agreement.

CG 20 32 Additional Insured - Engineers, Architects or Surveyors Not Engaged by the Named Insured

Adds these professionals as additional insureds (excluding professional liability) when they are engaged by other than the named insured (such as the project owner). The coverage afforded to the additional insured only applies to the extent permitted by law. If additional insured status is required by contract or agreement, coverage and limits of liability apply only to the extent required in the contract or agreement. This endorsement was withdrawn from use in 2012 but reinstated in 2013. See CG 33 92 for the special Texas endorsement introduced in 2012 but withdrawn in 2013.

CG 20 33 Additional Insured - Owners, Lessees or Contractors - Automatic Status When Required in Construction Agreement with You

Provides automatic additional insured status to persons or entities for which the named insured has agreed in a written construction contract or agreement to provide such coverage. Applies to ongoing operations only. Additional insured status applies only to the person or organization which has entered into the contract or agreement. (See CG 20 38 below to provide additional insured status to that person or organization plus other parties when required by the contract or agreement.) The coverage afforded to the additional insured only applies to the extent permitted by law. Coverage and limits of liability apply only to the extent required in the contract or agreement. This endorsement was withdrawn from use in 2012 but reinstated in 2013.

CG 20 34 Additional Insured - Lessor of Leased Equipment - Automatic Status When Required in Lease Agreement with You

Provides automatic additional insured status to persons or entities from whom the named insured leases equipment when the named insured has agreed in a written contract to provide such coverage. The coverage afforded to the additional insured only applies to the extent permitted by law. CG 20 35 Additional Insured – Grantor of Licenses – Automatic Status When Required By Licensor

Provides automatic additional insured status to persons or entities that have granted the named insured a license when the named insured has agreed in a written contract to provide such coverage. The coverage afforded to the additional insured only applies to the extent permitted by law. If additional insured status is required by contract or agreement, coverage and limits of liability apply only to the extent required in the contract or agreement.

CG 20 36 Additional Insured – Grantor of License

Provides additional insured status to a designated person or organization that has granted the named insured a license. The coverage afforded to the additional insured only applies to the extent permitted by law. If additional insured status is required by contract or agreement, coverage and limits of liability apply only to the extent required in the contract or agreement.

CG 20 37 Additional Insured – Owners, Lessees Or Contractors – Completed Operations

Provides additional insured status to a designated person or organization on a contractor’s policy for completed operations exposures. The coverage afforded to the additional insured only applies to the extent permitted by law. CG 20 38 Additional Insured – Owners, Lessees or Contractors – Automatic Status for Other Parties When Required in Construction Agreement

Provides automatic additional insured status to (1) persons or organizations with which the named insured has entered into a written construction contract or agreement and agreed to provide such coverage, and (2) other persons or organizations the named insured is required to add as an additional insured under that contract or agreement. (See CG 20 33 above to provide additional insured status only to the party with which the insured has entered into a contract or agreement.) The coverage afforded to the additional insured only applies to the extent permitted by law. Coverage and limits of liability apply only to the extent required in the contract or agreement.

CG 20 39 19 Additional Insured – Owners, Lessees or Contractors – Automatic Status When Required in Written Construction Agreement with You (Completed Operations)

CG 20 43 12 19 Additional Insured – Automatic Status When Required in Written Contract or Agreement

CG 21 00 Exclusion - All Hazards In Connection With A Designated Premises

Excludes premises, operations and products liability Coverage A and B claims arising out of the premises designated in the endorsement. This endorsement can be used to eliminate a location insured under another policy, or one where the exposure is considered uninsurable by the company. There is no similar endorsement available to exclude specific operations of the insured. (See CG 21 44)

CG 21 01 - Exclusion - Athletic or Sports Participants

Excludes bodily injury to any person practicing for or participating in any sports or athletic contest sponsored by the insured. The operations to which the endorsement applies must be shown on the endorsement or the schedule of classifications. Medical payments coverage for these individuals is excluded in the basic policy.

CG 21 04 - Exclusion - Products/Completed Operations Hazard

Excludes all liability arising out of the products and completed operations hazards. This endorsement is used when the company wants to avoid the entire products and completed operations exposure, or when all premises and operations classifications on the policy include this exposure and a separate limit for this coverage is not needed.

CG 21 06 Exclusion - Access or Disclosure of Confidential or Personal Information and Data-Related Liability - With Limited Bodily Injury Exception

Mandatory endorsement (unless CG 04 37 or CG 21 07 (below) is attached). Amends Exclusion "p" in Coverage A (Bodily Injury and Property Damage) and adds an exclusion to Coverage B (Personal and Advertising Injury) to preclude coverage for liability arising out of access to or disclosure of confidential or personal information, with an exception for bodily injury damages. See also endorsements CG 21 07 and CG 21 08 below.

CG 21 07 Exclusion - Access or Disclosure of Confidential or Personal Information and Data-Related Liability - Limited Bodily Injury Exception Not Included

Used as an alternative to mandatory endorsement CG 21 06 (above) when the insurer does not want to provide the limited exception for bodily injury damages.

CG 21 08 Exclusion - Access or Disclosure of Confidential or Personal Information (Coverage B Only)

Used as an alternative to endorsement CG 21 06 (above) when the insurer agrees not to amend Exclusion "p" in Coverage A (Bodily Injury and Property Damage). Adds an exclusion to Coverage B (Personal and Advertising Injury) to preclude coverage for liability arising out of access to or disclosure of confidential or personal information.

CG 21 09 Exclusion - Unmanned Aircraft

Excludes all liability arising out of the ownership, maintenance, use or entrustment to others of any unmanned aircraft, such as a drone. There is no exception for liability assumed under an insured contract. Endorsement CG 24 50 contains a similar exclusion but provides coverage for specified unmanned aircraft engaged in operations or projects shown in the endorsement and subject to a special limit shown in the endorsement.

CG 21 10 Exclusion - Unmanned Aircraft (Coverage A Only)

Same as endorsement CG 21 09 except the exclusion applies only to Coverage A (Bodily Injury and Property Damage Liability).

CG 21 11 - Exclusion - Unmanned Aircraft (Coverage B Only)

Same as endorsement CG 21 09 except the exclusion applies only to Coverage B (Personal and Advertising Injury Liability).

CG 21 16 - Exclusion - Designated Professional Services

Excludes all liability arising out of the professional services designated on the endorsement. There are many endorsements addressing specific, common professional activities, such as medical professional. This endorsement is used when no specific endorsement applies to the activities of the insured.

CG 21 17 - Exclusion - Movement of Buildings or Structures

Excludes all liability arising out of and occurring during the course of the movement of any building or structure, either by auto or "mobile equipment". This exposure should be insured on a Business Auto Policy.

CG 21 31 - Limited Exclusion - Designated Operations Coverage by a Consolidated (Wrap-Up) Insurance Program

Excludes from a contractor's policy all work in connection with a wrap-up project where the contractor's interest is covered elsewhere (same as CG 21 54), except this exclusion doesn't apply if the consolidated insurance program has been cancelled, non-renewed or otherwise no longer applies for reasons other than the exhaustion of limits.

CG 21 32 - Communicable Disease Exclusion

Not approved for general use in Texas, but may be used on large risks or on surplus lines policies. Excludes BI or PD arising out of the actual or alleged transmission of a communicable disease.

CG 21 33 - Exclusion - Designated Products

Excludes all liability for the product designated on the endorsement. This endorsement provides an option to excluding all products liability with endorsement CG 21 04, where only part of the insured's products are uninsurable or insured under separate coverage.

CG 21 34 - Exclusion - Designated Work

Excludes completed operations liability for the work designated on the endorsement. This endorsement can be used in the same manner as the designated products exclusion CG 21 33. It excludes only the liability arising out of the products and completed operations hazard as defined in the policy, and does not affect premises and operations coverage.

CG 21 35 - Exclusion - Coverage C - Medical Payments

Removes the medical payments coverage from the policy, but retains coverage for "first aid" expenses and transfers this coverage to the Supplementary Payments section of the policy. This endorsement has no effect on bodily injury liability coverage. Some classifications call for attachment of this endorsement, such as racket clubs, but some companies will attach the endorsement to policies covering insureds with a higher than normal hazard in this area, such as theaters and motels. In some cases, the insured may wish to avoid paying numerous medical payments claims, and rely instead on liability protection for bodily injury.

CG 21 36 - Exclusion - New Entities

Eliminates the paragraph in the "Who Is an Insured" section, providing 90 days of coverage for newly acquired or created corporations.

CG 21 37 - Exclusion - Employees and Volunteer Workers as Insureds

Eliminates liability protection for employees of the insured, other than the executive officers of a corporation, and for volunteer workers.

CG 21 38 - Exclusion - Personal and Advertising Injury

Removed all of Coverage B - Personal and Advertising Injury Liability. Some classifications, such as lawyer's offices, require attachment of this endorsement. See CG 22 96 for an alternative to this absolute exclusion for lawyers.

CG 21 39 - Contractual Liability Limitation

Eliminates so-called "blanket" contractual liability coverage by redefining an insured contract to include only incidental contracts in paragraphs "a" through "e" of the definition. Paragraph "f" is removed. Although coverage is retained for incidental contracts, such as lease of premises, the endorsement specifies that only written contracts are covered, not oral contracts. (See CG 22 74)

CG 21 41 - Exclusion - Intercompany Products Suits

Bars coverage for products liability claims between named insureds on the policy. This endorsement should be used whenever there is a sale of products, usually components, between multiple named insureds, such as a parent and subsidiary. Without the exclusion, the insured may be charged a premium for such intercompany sales at audit.

CG 21 42 - Exclusion - Explosion, Collapse and Underground Property Damage (Specified Operations)

Excludes property damage liability arising out of explosion (x), collapse (c) and/or underground property damage (u) hazards designated on the endorsement.

CG 21 43 - Exclusion - Explosion, Collapse, Underground Property Damage (Specified Operations Excepted)

Excludes these hazards at all locations and operations, except those specified in the endorsement.

CG 21 44 - Limitation of Coverage To Designated Premises, Project or Operations

Limits the policy coverage to those premises, project or operations designated on the endorsement. Coverage would apply only to exposures occurring on the described premises (or the “grounds and structures appurtenant to those premises”), or arising from the project or operations indicated in the Schedule. (See CG 21 00).

CG 21 45 - Exclusion - Damages to Premises Rented to You

Eliminates the $50,000 of legal liability coverage for negligent damage to rented premises.

CG 21 46 - Abuse or Molestation Exclusion

Excludes liability coverage arising out of actual or threatened abuse or molestation of a person in the custody of any insured or employee. This endorsement is not approved in Texas. See CG 26 46 for the appropriate Texas form. It is usually used on policies insuring risks which care for children, such as nurseries, schools, and day-care centers.

CG 21 47 - Exclusion - Employment-Related Practices Exclusion

Excludes bodily injury or personal injury arising out of employment practices of the insured, such as refusal to employ, termination, coercion, demotion, discipline, harassment, discrimination and other practices. This endorsement is not approved in Texas. See CG 26 39 for the appropriate Texas form. While Coverage A has always excluded bodily injury to employees, this optional endorsement clarifies that no coverage is provided for bodily injury arising out of employment practices, whether the claimant is an employee or not.

CG 21 49 - Total Pollution Exclusion

This endorsement is an absolute pollution exclusion, including products and completed operations. Not approved for general use in Texas, but could be used on a "large risk." See CG 21 55 below.

CG 21 50 - Amendment of Liquor Liability Exclusion

Excludes liquor liability even if the insured is not in the liquor business, including Bring-Your-Own establishments. Not approved for general use in Texas, but could be used on a "large risk."

CG 21 51 - Amendment of Liquor Exclusion - Exception for Scheduled Activities

general use in Texas, but could be used on a "large risk."

CG 21 52 - Exclusion - Financial Services

Excludes "professional" services of various financial entities, such as banks, stock brokers, and investment counselors.

CG 21 53 - Exclusion - Designated Ongoing Operations

Excludes specific operations in progress, all ongoing operations at a specified location, or all ongoing operations performed by the named insured, as designated in the endorsement.

CG 21 54 - Exclusion - Designated Operations Covered by a Consolidated (Wrap-Up) Insurance Program

CG 22 36 Exclusion - Products and Professional Services (Druggists)

Excludes the professional and products liability coverage of a druggist. All coverage is excluded for rendering or failing to render the professional services as a pharmacist, and liability relating to all products, whether the product is a drug or anything else sold by the insured. If coverage for these exposures is to be provided on the CGL, attach endorsement CG 22 69 for products liability only or CG 22 97 for products and professional liability.

CG 22 37 Exclusion - Products and Professional Services (Optical and Hearing Aid Establishments)

Excludes liability arising out of the products and professional services of the named risks. Coverage can be provided with endorsement CG 22 65.

CG 22 38 Exclusion - Financial Institutions

Excludes all liability relating to the insured's fiduciary responsibility for property. Limited coverage can be provided with endorsements CG 24 05 and CG 24 11.

CG 22 39 Exclusion - Camp or Campgrounds

Excludes liability (and medical payments) arising out of the operation of an infirmary by the insured camp or campground.

Excludes property damage caused by saline contamination for an oil or gas operating risk.

CG 22 48 Exclusion - Insurance and Related Operations

Excludes "errors and omissions" type liability exposure for insurance companies, agents/brokers, and service organizations. Since the endorsement excludes personal and advertising injury, including libel, slander and invasion of privacy, insurance professionals should be certain their E&O policy covers these claims.

CG 22 50 Exclusion - Failure To Supply

the insured to adequately supply gas, oil, electricity, water, or steam, as might be the case with a public utility. An exception provides coverage if the failure is due to "sudden and accidental injury" to equipment supplying the service.

CG 22 60 Limitation of Coverage - Real Estate Operations

Limits liability coverage for the insured real estate operation to the office premises and real properties which the firm does not own, control or manage. See CG 22 70.

CG 22 62 Underground Resources and Equipment Coverage

Provides coverage for property damage to underground resources and equipment, establishing a special Aggregate limit for the coverage. The endorsement excludes the expense of bringing an out of control well under control. The insured is also obligated to take necessary measures, at his own expense, to bring a well under control to minimize property damage.

CG 22 63 Stevedoring Operations (Limited Completed Operations Coverage)

This endorsement provides completed operations coverage for the loading and unloading of vessels, without the need to purchase specific coverage.

CG 22 64 Pesticide or Herbicide Applicator Coverage

Texas uses a special endorsement for these risks. See CG 01 56.

CG 22 65 Optical and Hearing Aid Establishments

Provides malpractice insurance for optometrists and hearing aid establishments.

CG 22 66 Misdelivery of Liquid Products Coverage

Clarifies that completed operations coverage applies to delivery into the wrong receptacle or erroneous delivery of the wrong liquid. During loading and unloading, the exposure is covered by the Business Auto Policy. After unloading, the exposure is covered by the CGL.

CG 22 67 Corporal Punishment

Modifies the intentional injury exclusion (a) of Coverage A so that it does not apply to corporal punishment of a student by or at the direction of the insured. See endorsement CG 22 30 for a specific exclusion of corporal punishment.

CG 22 68 Operation of Customers' Autos on Particular Premises

Extends coverage to include BI or PD arising out of the operation of a customer's auto on the insured's premises for purposes other than parking, which is already covered by exception to the auto liability exclusion. This endorsement is used with auto service risks insured on a CGL, such as car washes, repair shops and tire dealers. Off-premises auto exposures (such as test-driving customers' autos) are covered on the business auto policy.

CG 22 69 Druggists

Provides products liability for a retail drug store, but excludes professional liability coverage arising out of consulting, referral or similar services, etc., with an exception for administering of vaccinations. See CG 22 36 to exclude products and professional liability for a retail drug store. See CG 22 97 to cover products and professional liability.

CG 22 70 Real Estate Property Managed

This endorsement makes the CGL of a real estate management firm excess over coverage provided by the property owner's CGL. It also excludes damage to property managed by the named insured.

CG 22 71 Colleges or Schools (Limited Form)

Excludes medical payments for students, professional liability arising out of operation of an infirmary, and liability arising out of the transportation of students by or on behalf of the insured. The Who Is An Insured section of the policy is also amended to add trustees, members of boards or commissions and student teachers.

CG 22 72 Colleges or Schools

Contains the same provisions as CG 22 71 except medical payments to students is covered.

CG 22 73 Exclusion - Oil or Gas Producing Operations

Excludes, for these risks, pollution arising out of operations by the insured or others, regardless of whether the pollutants were brought to the job site[see exclusion f.(1)(d)].

CG 22 93 Lawn Care Services – Limited Pollution Coverage

Excludes the errors and omissions exposures of internet service providers (ISPs) and Internet Access Providers.

CG 22 99 Professional Liability Exclusion – Web Site Designers

Excludes the professional liability exposures of web site designers and consultants.

CG 23 01 Exclusion – Real Estate Agents or Brokers Errors or Omissions

Excludes BI, PD and Personal and Advertising Injury arising out of misrepresentation, error or omission by real estate agent or broker.

CG 24 01 Binding Arbitration

Allows for the arbitration of disputes between the company and the insured, with the arbitrator's decision being binding on the parties. Not approved for general use in Texas. See CG 32 08 for Texas-approved form.

CG 24 02 Nonbinding Arbitration

Allows for the arbitration of disputes between the company and the insured, without the arbitrator's decision being binding on any party. Not approved for general use in Texas. See CG 32 09 for Texas-approved form.

CG 24 03 Waiver of Charitable Immunity

The company agrees that they will not use charitable immunity as a defense in claims against the insured. Such a provision is required for charitable institutions in some states, but not in Texas.

CG 24 04 Waiver of Transfer of Rights of Recovery Against Other To Us

Provides a specific waiver of subrogation for the designated person or organization, barring suit by the company which assumes the insured's rights after loss payment.

CG 24 05 Financial Institutions (Reporting Provision and Limitation to Fiduciary Interest)

Limits coverage to the insured's liability arising out of trust properties in which the insured has a fiduciary or representative interest. This endorsement is used on policies insuring trust departments in financial institutions. It requires periodic reporting of trust properties.

CG 24 06 Liquor Liability - Bring Your Own Alcohol Establishments

Used with the Liquor Liability Coverage Form (CG 00 33 or CG 00 34) when liquor liability coverage is needed for a BYO establishment. Clarifies that a BYO establishment is to be considered selling, serving or furnishing alcoholic beverages.

CG 24 07 Products/Completed Operations Hazard Redefined

Redefines the products hazard so that the definition of products applies to products consumed on the premises, once the product is relinquished to the customer. Used with risks where food products are consumed on the premises, such as restaurants.

CG 24 08 Liquor Liability

Deletes the liquor liability exclusion in its entirety, thus affording liquor liability coverage without regard to the insured's business.

CG 24 09 Governmental Subdivisions

Includes elected or appointed officials and members of boards or commissions as insureds under the policy of governmental entity. Also clarifies that autos used on city property (streets) do not meet the definition of "mobile equipment", but remain "autos" excluded under the CGL.

CG 24 10 Excess Provision - Vendors

Makes the vendor's policy excess over protection provided by the manufacturer's or distributor's policy under a vendors endorsement. See CG 20 15.

CG 24 11 Fiduciaries - Fiduciary Interest

Provides protection for financial institutions (including officers, employees and trust beneficiaries) for liability arising out of the ownership, maintenance or use of property in any trust for which the named insured is acting in a fiduciary or representative capacity.

CG 24 12 Boats

Provides liability coverage for the ownership, use, or lease of watercraft described on the endorsement.

CG 24 13 Amendment of Personal and Advertising Injury Definition

Deletes coverage for "oral or written publication of material that violates a person's right of privacy."

CG 24 14 Waiver of Governmental Immunity

Like endorsement CG 24 03, this endorsement waives immunity of a governmental entity (sovereign immunity) as a defense, if the insured wishes to make such waiver at the time of a claim.

CG 24 16 Canoes or Rowboats

Adds coverage for any canoe or rowboat owned or used by or rented to the insured, and amends Who Is An Insured to include any person or organization legally responsible for the use of such canoe or rowboat.

CG 24 17 Contractual Liability - Railroads

Eliminates from the CGL definition of "insured contract" the words, "except in connection with construction or demolition work on or within 50 feet of a railroad," to give coverage for easement agreements that obligate the insured contractor to indemnify a railroad. See CG 24 27.

CG 24 18 Seed Merchants - Coverage for Erroneous Delivery or Mixture and Resulting Failure of Seed to Germinate

Adds a separate insuring agreement to include coverage for property damage arising out of failure of seeds to germinate, erroneous delivery of seed, or error in mechanical mixture of seed.

CG 24 19 Seed Merchants - Coverage for Erroneous Delivery or Mixture (Resulting Failure of Seed to Germinate Not Included)

CG 24 21 Seed Merchants - Coverage for Erroneous Delivery or Mixture (Resulting Failure of Seed to Germinate Not Included)

CG 24 22 Amendment of Coverage Territory – Worldwide Coverage

Expands the definition of “coverage territory” to include anywhere in the world, and provides for reimbursement of the insured’s legal expenses and judgments if the insurer is prevented by law from directly defending or indemnifying in the country where a claim takes place.

CG 24 23 - Amendment of Coverage Territory – Additional Scheduled Countries

Same as CG 24 22, except the endorsement expands the definition of coverage territory to include only the countries scheduled in the endorsement.

CG 24 24 - Amendment of Coverage Territory – Worldwide Coverage With Specified Exceptions

Same as CG 24 22, except the endorsement expands the definition of coverage territory to anywhere in the world except countries scheduled in the endorsement.

CG 24 25 - Limited Fungi or Bacteria Coverage

Provides coverage for liability arising out of fungi (including mold) or bacteria, including remediation, subject to sublimit. See CG 21 67 for an absolute exclusion of coverage for fungi or bacteria.

CG 24 26 - Amendment of Insured Contract Definition

Amends the definition of insured contract to preclude contractual liability coverage for the sole negligence of the indemnitee. In addition, limits coverage to the extent that the insured's assumption of tort liability is permitted by law. This endorsement was withdrawn from use in 2012, but reinstated in 2013. CG 24 27 - Limited Contractual Liability - Railroads

Same as CG 24 17 except the coverage does not apply to the sole negligence of the indemnified railroad. In addition, limits coverage to the extent that the insured's assumption of tort liability is permitted by law.

CG 24 50 Limited Coverage for Designated Unmanned Aircraft

Excludes all liability arising out of the ownership, maintenance, use or entrustment to others of any unmanned aircraft, such as a drone, subject to an exception for specified unmanned aircraft engaged in operations or projects shown in the endorsement and subject to a special limit shown in the endorsement. There is no exception for liability assumed under an insured contract. See technical report Drones.

CG 24 51 Limited Coverage for Designated Unmanned Aircraft (Coverage A Only)

Same as endorsement CG 24 50 except the exclusion applies only to Coverage A (Bodily Injury and Property Damage Liability).

CG 25 16 Texas – Elevator Contractors

Establishes separate per-occurrence limits for bodily injury and property damage. If the state increases the required limits of $1,000,000 for BI and $500,000 for PD during the policy period, the limits are amended as needed to conform to Texas law. An elevator contractor is required to provide evidence of these limits when the contractor obtains a license from the Texas Department of Licensing and Regulation.

CG 26 37 Texas Changes - Condominiums

Amends policy provisions to comply with Texas Condominium Law. Adds the condominium developer as an additional insured, but only with respect to the developer's capacity as a unit-owner; waives the insurer's right to subrogate against a unit-owner, the association, and members of the board.

CG 26 39 Texas Changes - Employment-Related Practices Exclusion

Excludes bodily injury or personal injury arising out of employment practices of the insured. Coverage A already excludes bodily injury to an employee, but this endorsement clarifies that no coverage is provided for bodily injury arising out of employment practices, whether the claimant is an employee or not, in the circumstances at the time. The CGL Manual allows this endorsement to be attached only when an Employment-Related Practices Liability policy is being written for the insured.

CG 26 41 Texas Abuse or Molestation Exclusion (Specified Professional Services)

Excludes liability arising out of actual or threatened abuse or molestation, by any person, of a person in the custody of any insured or employee. Applies only to the professional services described in the endorsement.

CG 26 46 Texas Abuse or Molestation Exclusion

Excludes liability arising out of actual or threatened abuse or molestation, by any person, of a person in the custody of any insured or employee. Applies to all services covered on the policy.

CG 27 00 Category 27 Claims-Made Endorsements 27 02 - 27 11

These endorsements are for use with the ISO claims-Made CGL. The claims-made forms are not reviewed in this Policy Guide.

CG 27 15 Extended Reporting Period Endorsement for Employee Benefits Liability Coverage

Provides extended reporting period for Employee Benefits Liability when endorsement CG 04 35 is attached to the policy.

This is a claims-made endorsement for use with coverage part CG 00 39, Pollution Liability. It provides for an extended reporting time for claims arising out of occurrences covered by the policy.

CG 28 02 Insured Site Definition (Contractors)

Expands the definition of "insured site" in CG 00 39 and CG 00 40 to include any site on which the contractor performs operations for others.

CG 28 03 Supplemental Extended Reporting Period

This endorsement is for use with the claims-made liquor liability coverage part, CG 00 34.

CG 28 04 Earlier Notice of Cancellation Provided By Us

Used with Owners and Contractors Protective Coverage Form. Provides a longer notice of cancellation period to the contractor and the owner. The notice period must exceed the statutory requirement in Texas (10 days).

CG 28 05 Personal Injury

For use with OCP coverage part, CG 00 09, this amends the bodily injury definition to include the personal injuries of false arrest, detention or imprisonment.

CG 28 06 Limitation of Coverage To Insured Premises

Limits coverage afforded by Liquor Liability coverage part, CG 00 33, to the premises designated on the endorsement, or newly acquired premises for 30 days.

CG 28 07 Principal's Protective Liability Coverage Part

This endorsement converts the OCP coverage part, CG 00 09 , into a general Principal's Protective liability form, such as might be used for a newspaper publisher to provide coverage for independent contractors. Only bodily injury coverage is afforded by principal's protective insurance. Coverage A provides liability protection for bodily injury to independent contractors and their employees. Coverage B applies to liability caused by the independent contractor.

CG 28 12 Owners and Contractors Protective Liability - Pesticide or Herbicide Applicator Coverage

This endorsement to OCP coverage part, CG 00 09, provides broader pollution coverage for contractors involved in the named activities on behalf of a premises owner. Not approved for general use in Texas

CG 28 31 Railroad Protective Liability - Pollution Exclusion Amendment

This endorsement modifies the pollution exclusion so that coverage is afforded for off-premises pollution accidents involving fuels or lubricants brought to a job site by a contractor. Not approved for general use in Texas. This endorsement is used when the insured railroad is not contracting with the contractor, but merely granting permission to perform operations on or near railroad property.

CG 28 33 Pollution Liability - Voluntary Cleanup Costs Reimbursement

This endorsement extends coverage under Pollution Liability coverage form, CG 00 39, to include expenses associated with voluntary cleanup of a pollution discharge, if done to prevent damage.

CG 33 93 Texas Additional Insured - Owners, Lessees or Contractors - Automatic Status When Required in Construction Agreement with You

Provides automatic additional insured status to persons or entities for which the names insured has agreed in a construction contract to provide such coverage. Applies to ongoing operations only. This endorsement was withdrawn from use in 2013.

CG 33 94 Texas Additional Insured – Owners, Lessees Or Contractors – Completed Operations

Provides additional insured status to a designated person or organization on a contractor's policy for completed operations exposures. This endorsement was withdrawn from use in 2013.

CG 33 95 Texas Additional Insured - Owners, Lessees, or Contractors - Scheduled Person or Organization

Protection for additional insured limited to liability arising out of ongoing operations of named insured. It does not provide coverage for liability arising out of completed operations, and it is not intended to cover the additional insured's own supervision of work. CG 33 96 Texas Additional Insured - Lessor of Leased Equipment

Adds the interest of the owner of equipment to a policy covering the named insured who leased the equipment. This endorsement was withdrawn from use in 2013. .

CG 33 97 Texas Additional Insured - Lessor of Leased Equipment - Automatic Status When Required in Lease Agreement with You

Provides automatic additional insured status to persons or entities from whom the named insured leases equipment when the named insured has agreed in a written contract to provide such coverage. This endorsement was withdrawn from use in 2013.
